Terms of Use

This document is an electronic record in terms of the Information Technology Act, 2000 and rules thereunder as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. Agreement to Terms

This terms of use agreement (“Terms”) constitutes a legally binding contract between www.essentialsinteriors.com and our affiliates (collectively, “Essentials Interiors,” “we,” “us”), and you, with respect to your use of all properties (Web, mobile or otherwise) owned or operated by Essentials Interiors (collectively, the “Properties”), and all products and services available from Essentials Interiors, Professionals (as defined below) or other third parties in connection with the Properties (individually and collectively with the Properties, the “Services”). By using the Services, you acknowledge that you have read, understood, and agree to be bound by, the Terms. If you do not agree to the Terms, please do not use the Services.

Changes to Terms

Any changes to the Terms will be effective immediately upon posting. Please review the Terms each time you use the Services as your continued use of the Services after such changes will constitute acceptance of, and agreement to, such changes. You further waive any right you may have to receive specific notice of such changes.

Consent

You affirm that you are at least 18 years of age and are fully able and competent to enter into, and comply with, these Terms. If you are accessing and using the Services on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms. In that situation, “you” and “your” will refer to both you and that entity.

Essentials Interiors is an online platform to get estimates for home renovation and setup projects and get them done by highly recommended professionals.

No Endorsement

Essentials Interiors does not sponsor, endorse, recommend, or approve of any professional who offers products or services through the Services. While we try to confirm that professionals meet certain requirements, we cannot and do not represent or warrant that any professional is licensed, qualified, bonded, insured, or capable of performing any service. Reference to any products, services, or other information by trademark, manufacturer, supplier, or otherwise does not constitute or imply an endorsement, sponsorship, or recommendation by us. Any estimate provided in connection with the Services is only a guide; it is not a guarantee of the actual cost of your specific project.

Content Shown on the Site

All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, projects, music, and artwork (collectively, “Content”), is a third-party user-generated content and Essentials Interiors has no control over such third-party user-generated content as Essentials Interiors is merely an intermediary for the purposes of this Terms of Use.

Provided Services

Products and services provided by professionals are made available to you pursuant to both (i) a communications platform that enables connections between you and professionals and (ii) a payments platform that provides a medium of exchange of money between you and professionals to facilitate the provision of goods and services.

Pricing Information

While www.essentialsinteriors.com strives to provide accurate service and pricing information, pricing errors or typographical errors may occur. We cannot confirm the price of a project until after you order. In the event that a project is listed at an incorrect price or with incorrect information due to an error in pricing or product information, www.essentialsinteriors.com shall have the right, at our sole discretion, to refuse or cancel any orders placed for that project, unless the project has already been started. In the event that an item carries an incorrect price, www.essentialsinteriors.com may, at its discretion, either contact you for instructions or cancel your order and notify you of such cancellation.

Taxes

You understand that we are acting solely as an intermediary for the collection of service charges and fees between a Service User and a Service Professional who choose to enter into an Agreement for Service. Because taxes vary significantly based on the registration and method you have opted for, you understand and agree that you are solely responsible for determining your own tax reporting requirements in consultation with tax advisors, and that we cannot and do not offer tax advice to either Service User or Service Professional. Further, you understand that Essentials Interiors shall not be responsible or liable in any manner in relation to tax liability of a Service User or a Service Professional.

Order Cancellations and Refund

Once confirmed with payment, design or production advance cannot be refunded. Defective parts will be replaced under the conditions of the provided warranty.

Electronic Communications

You consent to receive communications from us electronically. www.essentialsinteriors.com will communicate with you through email and SMS or by posting notices on the Site.

Project Specifications

While we make every effort to specify all projects that are done on the Site as accurately as possible, there can be errors or missed-out specifications. You are advised to coordinate with the professional and ensure that the professional takes the right measurements and that the right product is being made. We cannot guarantee that your project will look as you had requested it to be.

Limitation of Liability

IN NO EVENT SHALL THE ESSENTIALS INTERIORS PARTIES BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER ARISING OUT OF, BASED ON, OR RESULTING FROM YOUR USE OF THE SERVICES AND YOUR USE OF, OR TRANSACTIONS WITH, ESSENTIALS INTERIORS, PROFESSIONALS OR OTHER THIRD PARTIES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, NEGLIGENCE OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT ESSENTIALS INTERIORS IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.

Any claims relating to the use of the Services must be brought within one (1) year from the date the cause of action arose. Claims brought after such period are VOID.

Modification of Services

We reserve the right to modify, restrict access to, or discontinue the Services (or any portion of the Services), temporarily or permanently, with or without notice to you, and are not obligated to support or update the Services. Unless explicitly stated otherwise, any new features that augment or enhance the current Services shall be subject to these Terms.

Termination

We reserve the right, with or without notice, and in our sole discretion, to terminate any license to the Services, in whole or in part, and to block or prevent future access to and use of the Services.

Warranty Terms

Warranty for interior projects covers the following:

• Lifetime warranty against rust on accessories from Hettich
• Manufacturing defects in material
• Termite and fungus
• Product failure

Warranty is void under the following conditions:

• Complete payment is not made for the project.
• Damages due to misuse, tampering, abuse, fire, and natural calamity scratches, rips, etc.
• Damages due to negligence and unauthorized usage
• Continuous contact with water
• Shifting of furniture without dismantling
• Furniture directly exposed to sunlight

Other Terms and Conditions

• The warranty is not applicable on any components supplied or installed by third-party vendors.
• When choosing a color or finish, you must remember that samples only offer a general indication of the design, drawing, aesthetics, color, and finish. There is no guarantee that the samples are an exact replica and they may vary slightly from the components installed.
• In no event shall Essentials Interiors be liable for any loss of revenue or profits, loss of use of equipment, or other consequential or incidental damages resulting from the use, installation, performance, or failure of its products. Essentials Interiors is not liable for any damages or physical injury arising out of improper use, modification, alteration, unauthorized use, or poor maintenance of the product.
• In no event shall Essentials Interiors’ liability under any contract exceed in any manner the value of the products sold or supplied.
• Any replacement required post-installation, which is outside the warranty terms, will be chargeable to the client.
• The company has a right to rework/repair/replace only the defective part of the furniture.

Pricing Policies

Essentials Interiors provides a customized quote based on your requirements using our proprietary pricing engine.

Payments are to be made in multiple installments. Essentials Interiors will provide you with the breakup and links to make payments as per installments as and when required.
